《优化营商环境条例(征求意见稿)》分为总则、市场主体、市场环境、政务服务、监管执法、法治保障、附则7章,共68条。其中,在“市场主体”部分,《条例》强调了平等对待各类市场主体,包括市场准入、平等获取要素、招标投标和政府采购等环节。"市场环境"主要围绕破解市场主体生产经营活动中可能遇到的痛点难点堵点问题,从便利生产经营,规范税费办理,公用事业、融资与人才服务三个方面,对企业开办等内容进行了规定。近年来,党中央、国务院围绕深化“放管服”改革、优化营商环境作出了一系列重大决策部署,通过制定《条例》,有利于更加全面系统贯彻落实这些决策部署,更加有力推动优化营商环境工作。此外,制定《条例》是提升营商环境法治化水平的重要举措,也是破解当前营商环境痛点堵点难点问题的迫切需要。
